These Terms and Conditions ("Terms") govern your access to and use of the Travelens mobile application and related services (the "App"), operated by Travelens ("Travelens", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and that the information you provide is accurate and complete.
2. Your Account
- You may use the App as a guest (identified by a device identifier) or by signing in with Google. Before signing in, you must review and accept these Terms and our Privacy Policy.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate account and profile information and to keep it up to date.
- Notify us immediately at support@travelens.in of any unauthorized use of your account.
3. The Service
Travelens provides AI-generated travel planning, including suggested destinations, multi-day itineraries, places to visit, hotels, restaurants, maps, and related recommendations.
The content is for informational and planning purposes only. Itineraries, ratings, prices, durations, opening details, hotel and restaurant suggestions, and locations are generated automatically and may be inaccurate, incomplete, or out of date. You are responsible for independently verifying all information—including prices, availability, travel advisories, safety conditions, visa and entry requirements, and operating hours—before making any travel decisions or bookings.
Travelens does not provide booking, payment, or reservation services and is not a travel agent, tour operator, or seller of travel.
4. AI-Generated Content
Itineraries and recommendations are produced using automated and AI-based systems. Such content may contain errors or "hallucinations" and does not constitute professional travel, legal, medical, or safety advice. You use AI-generated content at your own risk and discretion.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful, harmful, or fraudulent purpose.
- Attempt to gain unauthorized access to the App, its servers, or other users' data.
- Interfere with, disrupt, or overload the App or its infrastructure.
- Reverse engineer, decompile, or attempt to extract source code, except as permitted by law.
- Scrape, copy, or redistribute content from the App on a commercial scale without our permission.
- Misuse location, search, or other features to harass others or violate applicable laws.
6. Location and Permissions
Some features (such as "Nearby" and "Weekend" recommendations) require access to your device location. Granting this access is voluntary; you may decline or revoke it via your device settings, in which case those features may not work. Your use of location data is also described in our Privacy Policy.
7. Third-Party Services and Content
The App integrates with third-party services, including Google Sign-In, Google Firebase (analytics and push notifications), Google AdMob (advertising), Google Maps (maps and geocoding), cloud hosting (e.g., Microsoft Azure), and image hosting. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services, their content, or their availability.
7A. Advertising
The App is supported by advertising served through Google AdMob. By using the App, you acknowledge that ads may be displayed within it and that ad providers may use device and usage information (including your advertising identifier) to deliver and measure ads, as described in our Privacy Policy. You agree not to interfere with, obscure, click fraudulently on, or otherwise misuse the ads shown in the App.
8. Intellectual Property
The App, including its design, software, branding, and original content (excluding user content and third-party content), is owned by Travelens and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.
9. User Content
If you submit content (such as preferences, searches, or saved itineraries), you grant Travelens a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely to operate and improve the App. You are responsible for the content you submit and represent that you have the rights to submit it.
10. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RECOMMENDATION OR INFORMATION WILL BE ACCURATE OR RELIABLE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVELENS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR TRAVEL-RELATED COSTS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP OR RELIANCE ON ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM OR INR 1,000.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Travelens and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the App and request account deletion at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
14. Changes to the App and Terms
We may modify or discontinue the App (or any feature) at any time. We may also update these Terms from time to time; when we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable law, the courts located in India will have exclusive jurisdiction over any disputes arising from these Terms or the App.
